Freelancer Terms of Service

FindAITalents ("we," "us," or "our") operates the platform at https://intimigram.com/ (the "Site"), an AI-powered marketplace connecting businesses with top AI freelancers and professionals (the "Services"). These Freelancer Terms of Service ("Terms") govern your use of the Site and Services as a freelancer, talent, or independent contractor ("you" or "Freelancer").

By creating a freelancer profile, applying to opportunities, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

To use the Services as a Freelancer, you must:

• Be at least 18 years old and capable of forming a binding contract
• Provide accurate, complete, and up-to-date profile information
• Possess the legal right to work in the jurisdictions where you offer services
• Not be barred from using the Services under applicable law

You are solely responsible for ensuring compliance with all local laws, tax obligations, and licensing requirements related to your freelance work.

2. Account Registration

You must create a verified account to access full freelancer features. You agree to:

• Provide truthful information during registration and profile setup
• Maintain the security of your account credentials
• Promptly update any changes to your contact or professional details
• Not create multiple accounts or impersonate others

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Freelancer Profile & Content

You are responsible for all content you upload, including:

• Resume, portfolio, AI project samples, code snippets, and certifications
• Profile photo, bio, skills, rates, and availability
• Messages, proposals, and communications with clients

You grant FindAITalents a worldwide, non-exclusive, royalty-free license to use, display, and distribute your profile content solely to facilitate job matching and platform functionality.

You represent and warrant that:

• All content is accurate and not misleading
• You own or have rights to all submitted materials
• Your content does not violate third-party intellectual property, privacy, or publicity rights

4. Job Applications & Matching

FindAITalents uses AI algorithms to match freelancers with client opportunities. You may:

• Browse and apply to posted projects
• Receive AI-recommended opportunities
• Be contacted directly by clients based on your profile visibility

Submitting a proposal does not guarantee selection. Clients make final hiring decisions.

You agree not to:

• Apply to jobs you are not qualified for
• Spam clients with unsolicited messages
• Circumvent the platform by negotiating off-site before a contract is formed

5. Contracts & Payments

All work agreements are between you and the client. FindAITalents is not a party to freelance contracts.

Payments are processed through our escrow system or third-party providers. You agree to:

• Set clear milestones and deliverables in client agreements
• Invoice only for completed, approved work
• Pay applicable service fees (as displayed at checkout or in your dashboard)

Service Fee: FindAITalents charges a platform fee on earnings (typically 10–15%, subject to change with notice). Fees are deducted before payout.

Payouts are issued within 3–7 business days after client approval and fund release, subject to verification.

6. Freelancer Obligations

You agree to:

• Deliver high-quality work on time and as agreed
• Communicate professionally and responsively
• Honor confidentiality and NDAs signed with clients
• Resolve disputes directly with clients in good faith
• Comply with our Community Standards and anti-discrimination policies

You must not engage in:

• Fraud, plagiarism, or submitting AI-generated work as your own without disclosure
• Sharing client data outside the platform
• Harassment, abuse, or discriminatory behavior

7. Ratings & Reviews

Clients may leave public feedback after project completion. Ratings impact your visibility and AI match score.

You may respond to reviews once per project. We moderate reviews for spam, abuse, or policy violations.

Consistently low ratings (below 3.5/5 over 5+ projects) may result in reduced visibility or account suspension.

8. Intellectual Property

Unless otherwise agreed in writing with the client:

• You retain ownership of pre-existing IP you bring to a project
• Clients own work product delivered under a paid contract
• You grant clients a perpetual, royalty-free license to use deliverables

FindAITalents claims no ownership over project deliverables but may showcase anonymized work samples (with consent) for marketing.

9. Termination

You may close your account at any time via settings. Upon closure:

• Active contracts must be completed or canceled per client agreement
• Earnings in escrow will be paid out per schedule
• Your profile will be deactivated and removed from search within 30 days

We may terminate or suspend your access immediately if you:

• Violate these Terms
• Engage in fraud, abuse, or illegal activity
• Receive excessive client disputes or negative feedback

10. Disclaimers & Limitation of Liability

The Services are provided "as is." We do not guarantee:

• Job offers, client payments, or project success
• Accuracy of AI matching or client information
• Continuous, uninterrupted access to the platform

To the fullest extent permitted by law, FindAITalents is not liable for indirect, incidental, or consequential damages, including lost income, data, or opportunities.

Our total liability shall not exceed the service fees we collected from you in the 6 months prior to the claim.

11. Dispute Resolution

Client-freelancer disputes should first be resolved directly. If unresolved, you may escalate via our support team.

For disputes with FindAITalents, these Terms are governed by the laws of the State of Delaware, USA. Any legal action must be filed in Delaware courts.

You agree to attempt informal resolution for 30 days before formal claims.

12. Changes to Terms

We may update these Terms with notice via email or in-app alert. Material changes take effect 7 days after notice.

Continued use of the Services after changes constitutes acceptance.

By using FindAITalents as a freelancer, you confirm that you have read, understood, and agree to these Freelancer Terms of Service.
